iPulse Terms of Use

Please read these Terms of Use (“Terms”, “Agreement”) carefully before using the iPulse mobile application (the “Application” or “App”) and related services (the “Service”). By downloading, accessing, or using iPulse, you agree to be bound by these Terms. If you do not agree, please stop using the Service.

1. Interpretation and Definitions

(1) Interpretation

Words with capitalized initials have specific meanings. These definitions apply regardless of singular or plural form.

(2) Definitions

• Application: iPulse software provided by the Company, installed on any electronic device.
• Application Store: Apple App Store or Google Play Store.
• Company: Referred to as “iPulse”, “We”, “Us” or “Our” in this Agreement.
• Device: Any device capable of running iPulse, such as a smartphone or tablet.
• Free Trial: A limited period during which certain Subscription features may be available without charge.
• In-app Purchase: Purchases of products, features, or subscriptions through the Application, subject to these Terms and the Application Store’s terms.
• Service: The Application and related features provided by iPulse.
• Subscriptions: Paid access plans to unlock premium features of the Service.
• You: The individual using the Service, or the entity on whose behalf such individual uses the Service.

2. Acknowledgment

• You are at least 18 years of age, or using the Service under the supervision of a parent or guardian.
• You have read and agree to these Terms and our Privacy Policy.
• iPulse is not a medical tool. It is designed for wellness and informational purposes only, and is not intended for diagnosis, prevention, or treatment of any condition.

3. Subscriptions

(1) Subscription Period

Access to premium features requires a paid subscription. Fees are charged in advance on a recurring basis (weekly, monthly, or yearly), depending on the plan. Subscriptions renew automatically unless canceled before the end of the current billing cycle.

(2) Cancellations

You may cancel via your Application Store account settings. Cancellations take effect at the end of the current billing period. Payments already made are non-refundable, except as required by law.

(3) Billing

All payments and billing processes are managed by the Application Store in accordance with its policies.

(4) Price Changes

We may update Subscription fees. If we do, you will receive prior notice and may cancel before changes take effect. Continued use of the Service after price changes constitutes acceptance.

(5) Refunds

Refunds are generally not provided, except as required by applicable law or the Application Store’s policies. Please direct refund requests to the Application Store.

(6) Free Trial

We may offer a Free Trial at our discretion. If billing information is required, you will only be charged once the Free Trial ends, unless you cancel before expiration.

4. In-app Purchases

The Application may offer In-app Purchases. These are:

• Non-refundable once delivered, unless required by law.
• Managed by the Application Store under its own terms.
• Usable only within the Application and not exchangeable for cash.

If an In-app Purchase fails or is defective, please contact the Application Store.

5. Intellectual Property

All content, features, and functionality of iPulse are owned by the Company or its licensors. You may not copy, modify, or distribute any part of the Service without our prior written consent.

6. Links to Third-Party Services

iPulse may contain links to third-party websites or services. We are not responsible for their content, policies, or practices. Use of third-party services is at your own risk.

7. Termination

We may suspend or terminate your access to iPulse at any time without prior notice if you violate these Terms. Upon termination, your right to use the Service ends immediately.

8. Limitation of Liability

To the fullest extent permitted by law:

• iPulse is provided on an “AS IS” and “AS AVAILABLE” basis.
• We are not liable for indirect, incidental, or consequential damages, including data loss, business interruption, or inaccuracies in wellness data.
• Some jurisdictions may not allow certain exclusions; in such cases, our liability will be limited to the maximum extent permitted by law.

9. Governing Law

These Terms are governed by the laws of your country of residence, unless overridden by mandatory local laws.

10. Dispute Resolution

If you have a concern or dispute, please first contact us at apple@shilutech.net to attempt an informal resolution.

11. United States Legal Compliance

• You represent and warrant that you are not located in a country embargoed by the U.S. government.
• You are not in any U.S. government list of prohibited or restricted parties.

12. Severability and Waiver

• If any provision is found invalid, the remaining Terms will remain in effect.
• Failure to enforce any provision does not constitute a waiver of future enforcement.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated with reasonable notice. Continued use of iPulse constitutes acceptance of updated Terms.
